It’s now a few years since 2018, when Guernsey introduced updated Data Protection Laws that expanded requirements for anybody handling personal data to deal with it securely, fairly and legally. 

For most people in business, the underlying aims of requirements didn’t need to be expressly stated - so compliance has been achieved largely by tightening up and codifying procedures that were already in place. There were, of course, some new areas and we are all now much better at telling our clients what our Data Protection policies and procedures are.

For many years, larger and / or Regulated businesses have been required to register with the Data Protection Commissioner as Data Controllers.  These requirements have remained in place since 2018, but smaller businesses and individuals have avoided the need to register as there have been a number of exemptions, where processing of personal data is not significant.

Almost all of the remaining exemptions will fall away now after 31 December 2020 and all businesses and data processors will need to register from 1 January 2021.

We are currently writing to our clients to explain the new requirements and our understanding of how they may apply to their individual circumstances. We will assist our clients with the process of registration if they ask us to.
